AI cover songs in 2026: risk tiers after the Suno and Udio settlements
Late 2025: UMG settled with Udio. WMG settled with both. Suno dropped its fair-use defense. The risk profile of AI cover songs is now sharper, and depends entirely on what you do with the cover.
The legal landscape for AI cover songs changed in two months at the end of 2025, and most of the people I see making AI covers have not adjusted their assumptions. Universal Music Group settled with Udio in October. Warner Music Group settled with both Udio and Suno in November. As part of those settlements, Suno dropped its fair-use defense and implemented a strict opt-in mechanism for major-label artists.
What this means in practice depends entirely on what you actually do with an AI cover. The legal risk is not a single number; it sits on a sliding scale, and the slope is steeper than the discourse around it suggests.
This article is not legal advice. I am not a lawyer, and the answer to "is this specific thing okay" depends on jurisdiction, intent, the specific source material, and how the rights holder feels about it on a given Tuesday. What this article tries to do is sort the most common AI cover activities into risk tiers based on the actual settlements, the actual case law, and the actual enforcement patterns of the major rights holders.
What changed in late 2025
A short factual recap, because the settlements were not as well-covered in the music press as they probably should have been.
UMG sued Udio in June 2024, alleging that Udio's models had been trained on UMG-owned recordings without authorization. The two parties reached a settlement in October 2025. The terms are not fully public, but a key element involves an opt-in licensing structure for UMG artists going forward.
WMG settled with both Udio and Suno in November 2025. The Suno settlement is more interesting because Suno had previously argued, in a related dispute, that training on copyrighted recordings was protected as fair use. Suno's settlement included dropping that defense and committing to an opt-in process for major-label artists, structurally similar to the UMG/Udio framework.
Sony Music has not yet publicly settled. Some industry coverage suggests Sony is in active negotiation with both companies; others suggest Sony is holding out for harder terms. As of early May 2026, no settlement is on the public record.
The collective effect of these settlements is that the largest AI music platforms can no longer credibly claim that their training data was fair use, at least for the catalogs of the labels they have settled with. That changes the legal analysis for anything those platforms produce, including AI covers.
The right of publicity and voice cloning
A separate but related issue. The right of publicity is a state-level doctrine in the US that protects a person's likeness, voice, and identity from unauthorized commercial use. It is not a federal statute, which means the rules vary across state lines.
Tennessee's ELVIS Act (Ensuring Likeness Voice and Image Security), passed in March 2024 and effective July 2024, was the first state law explicitly written to address AI voice cloning. The law makes it a Class A misdemeanor to use AI to make a recording mimicking another person's voice without permission. New York and California have similar bills in various stages.
For AI cover songs specifically, this matters most when the cover sounds recognizably like a specific named artist. AI Drake. AI Taylor Swift. AI Ariana Grande. The right of publicity is the legal framework that makes those covers risky regardless of what the model platforms have settled with the labels.
Most of the AI cover work that ordinary creators do is not in this category. A cover that swaps the source's voice for a generic male tenor, a synthwave production, or a folk arrangement does not implicate the right of publicity because no specific named artist's voice is being mimicked. A cover that specifically tries to sound like Drake does, regardless of how the AI was trained.
AI-only output is not copyrightable in the US
A third piece of the landscape. The US Copyright Office has held consistently, including in its March 2023 guidance and confirmed across several refusal-of-registration cases through 2024 and 2025, that AI-only output is not copyrightable. A human author has to make creative choices that survive into the work for it to be eligible.
For AI cover songs, this means: if you generate a cover by typing a prompt and accepting the output, the output is in the public domain in the US. You cannot stop someone else from using it. You also cannot register it with a Performing Rights Organization or a Mechanical Rights collective, which means you cannot collect royalties on it.
If you treat the AI generation as a starting point and add substantive creative work — re-singing the lead, replaying instruments, restructuring the arrangement, mixing and mastering with substantial human judgment — the resulting work has a stronger copyright claim, but only over the parts you actually contributed. The AI-generated underlying remains uncopyrightable.
Risk tier 1: private listening
You generate an AI cover and listen to it on your own headphones. You do not share it.
This is close to zero risk. There is no enforcement mechanism for what people listen to privately, and no plausible legal theory under which private listening to an AI generation infringes anyone's rights. The settlements between the labels and the AI platforms do not bind individual listeners.
This is also the only tier where I would describe the legal status as "fully safe" in any meaningful sense. Everything above this tier introduces some amount of risk.
Risk tier 2: non-monetized social posts
You generate an AI cover and post it to Instagram, TikTok, or your personal site without monetization.
Low practical risk in early 2026, but not zero. Two real concerns:
The first is content ID systems. YouTube's Content ID, Meta's Rights Manager, and TikTok's content protection systems can flag AI covers based on melody similarity to copyrighted recordings. The action is usually a takedown or a redirect of monetization to the rights holder, not legal action. If your cover preserves the source melody clearly, expect some platforms to detect it.
The second is the right of publicity for vocal cloning. If your cover sounds like a named artist, the right of publicity applies regardless of monetization. Tennessee's ELVIS Act does not have a "but I wasn't making money" carve-out.
For non-monetized posts of covers that do not mimic a specific named artist, the practical risk in early 2026 is low. Takedowns are the most common outcome; lawsuits against individual posters are vanishingly rare.
Risk tier 3: monetized YouTube uploads
You upload an AI cover to YouTube with monetization enabled, with ads running before or during the video.
This is where the risk profile jumps. Monetization changes the legal analysis in two ways.
The first is that the right of publicity in most US states explicitly covers commercial use, which monetized YouTube clearly is. If your cover sounds like a named artist, monetization moves you from a misdemeanor-tier risk to potentially actionable territory.
The second is that monetization makes content ID actions more impactful. A flagged cover on a non-monetized post is a takedown. A flagged cover on a monetized post is a redirect of revenue to the rights holder, who may also issue a strike against your channel. Three strikes and the channel is gone.
A practical pattern that some creators use: turn off monetization for AI cover videos specifically, run them as engagement content, and monetize other videos. This keeps the right-of-publicity exposure lower and avoids the strike risk.
Risk tier 4: distribution through DSPs
You distribute an AI cover through Spotify, Apple Music, or a digital distribution platform like DistroKid.
This is the highest-risk tier for ordinary creators, and the one I would advise treating as a legal hazard zone in 2026.
DSP distribution involves several layers of attestation. You typically have to declare that you own the rights to the recording, that you have the necessary mechanical license for the underlying composition (covers require a mechanical license), and that the recording does not infringe anyone's right of publicity. Each of these declarations is a contractual representation; misrepresentation can lead to takedown, account termination, and depending on the platform, potential civil liability.
For an AI cover, all three declarations are at minimum questionable. The recording is generated by a model trained on data that probably includes copyrighted material; the mechanical license requires you to be paying the composition's rights holders, which AI cover generators do not currently do; and the right of publicity question depends on whether the vocal sounds recognizably like an artist.
If you want to distribute AI-generated music through DSPs, the safest path is to use AI for from-scratch original songs (not covers) and to ensure no specific artist's voice is being mimicked. AI covers of existing copyrighted songs through DSPs are a strict-no in my book; the contractual liability alone is enough to make me avoid it.

For tier 4 use cases, do not distribute AI covers of existing copyrighted songs through DSPs in 2026. The contractual representations are too risky and the platforms are actively scanning.
A note on the trajectory
The legal framework for AI music is changing fast. The label settlements in late 2025 were not the end of the story; they were the beginning of a new framework. Expect more settlements through 2026 (Sony is the most obvious next domino), expect more state-level right-of-publicity laws, and expect federal legislation to start moving.
The risk profile I described above is a snapshot of early May 2026. In six months it might be different in either direction. If you are building anything serious on AI cover songs, follow the legal news rather than treating any single article as durable advice.
The thing that has not changed and will not change is the underlying principle: a cover song uses someone else's composition. That has always required a license, and it still does, regardless of how the cover is produced. The settlements have made the AI tooling part of the equation more honest about that. They have not changed the underlying reality.
